Murder Charge Stands

Constance Addison's attorney filed to have her murder charge dismissed. In a hearing this morning at the Sutter County Superior Courthouse, the request was denied.

She is charged with: PC187(a)- F-Murder, PC191.5(a)- F-Gross Vehicular Manslaughter While Intoxicated, VC20001(b)(1)- F-Hit & Run Resulting in Injury; and PC273a(b)- M-Child Endangering- Cruelty to Child.

The trial date is set for the beginning of next year, Tuesday, January 5, 2021 at 9:00 am.

Trial readiness date is set for Thursday, December 31, 2020 at 9:00 am.

Felony Pre-Trial Rescheduled for Friday, 10/2

The felony pre-trial conference scheduled for yesterday was rescheduled to take place with the hearing on Friday at 9 a.m. at the Sutter County Superior Courthouse. The hearing is to address the motion filed by Addison to set aside the PC187(a)-F-Murder charge.

California Bill Would Allow DUI Charges To Be Dismissed

What?! We're wondering how this could be a good idea.

"AB 3234 includes a long list of crimes where offenders could be offered diversion programs by judges to avoid a criminal record – and avoid jail time."

Mothers Against Drunk Driving also opposes AB 3234:

“For 40 years, MADD has fought to make streets safe from drivers impaired by alcohol and drugs—this bill threatens public safety by allowing almost all impaired drivers to avoid accountability. AB 3234 is so bad that even DUI cases that result in injuries are eligible for diversion, despite any objections from prosecutors and victims. AB 3234 does not honor the memory of impaired driving victims. Instead, the proposal undermines the seriousness of this crime. It isn’t right and we urge all Californians to join us in opposing AB 3234,” said Patricia Rillera, California State Executive Director, Mothers Against Drunk Driving, MADD California.

Meanwhile, it's been almost a year since Alec lost his life to a drunk driver, and the case hasn't even been to trial yet.

A life was taken. Others were endangered. Driving under the influence is serious.
